Transavia Flight Cancellation Compensation

Transavia refund. Transavia flight cancellation compensation.

When can you get compensation, and when — a refund? Can you get both? Here we will focus on these questions. There are various different reasons why your Transavia flight can get cancelled. But all you need to know is, if your flight is cancelled due to the airline’s fault, you may be entitled to both – a full refund from Transavia and cancellation compensation up to €600.

In case of Transavia, it applies to most flights to and from the EU.

There are two ways you can claim flight cancellation compensation.

1. Transavia Flight Cancellation Compensation: EU Regulations

What happens if your Transavia flight is cancelled?

Will you be booked on a different flight for free? Can you get a full refund if the new flight doesn’t meet your needs? In which cases you are entitled to flight cancellation compensation?

According to EU law, flight cancellation procedures are very specific.

If you are notified of the cancellation 7 – 14 days before the scheduled time of departure:

  • You choose a new flight offered by your airline, which departs not more than 2 hours before the original departure time and you reach your destination less than 4 hours after the original arrival time. In this situation you are not entitled to compensation.
  • In other situations you are entitled to compensation.

If you are notified of the cancellation less than 7 days before the scheduled time of departure:

  • You choose a new flight offered by your airline, which departs not more than 1 hour before the original departure time and you reach your destination less than 2 hours after the original arrival time. In this situation you are not entitled to compensation.
  • In other situations you are entitled to compensation.

Could you be entitled to Transavia flight cancellation compensation?

Yes, if the following conditions are met:

  • Cancellation must be due to the fault of Transavia;
  • It must be a last-minute flight cancellation (up to 14 days before departure);
  • Flight must be to/from Europe or the UK.

By Europe and EU here on this page (and on this website in general) we mean all EU Member States, the United Kingdom (UK), Guadeloupe, French Guiana, Martinique, Reunion, Mayotte, Saint Martin (French Antilles), the Azores, Madeira, the Canary Islands, Iceland, Norway, and Switzerland.

1.1 Extraordinary Circumstances

Sometimes reasons for flight cancellations are out of the airline’s control.

Situations like these are known as extraordinary circumstances. In such cases, you aren’t entitled to flight cancellation compensation no matter how last-minute is the cancellation.

If your flight is cancelled due to bad weather, national strike, terrorism threat or other security issues at the airport, you can’t get flight cancellation compensation. These events are out of airlines’ control. Airlines are not responsible for flight cancellations when they can’t do anything about it.

What about strikes? Because some of them are not considered extraordinary circumstances. If it’s a Transavia staff strike, and that causes cancellation, you might get compensation. Airline staff strikes are not considered extraordinary circumstances.

And, yes, make sure to double check what you’re told.

Because not always airlines are telling you the truth.

To avoid paying compensation, airlines often ignore compensation claims or give false reasons for flight delays and cancellations. You can either be prepared for that, and be persistent when claiming compensation. Or hand over your case to a flight compensation company. Our partners offer such services.

Just fill in the claim form on our website, and our partners will check your flight on your behalf.

1.2 Right to Care

Your Transavia flight is cancelled last-minute.

Now you have to wait at the airport for a new flight.

In this case you have a right to care from the airline.

All passengers in the EU have a right to care. If you have a last-minute cancellation, and you have to wait at the airport for the alternate flight, you have a right to receive care from the airline. As long as the waiting time at the airport is at least 3 hours. What can you get?

Transavia must offer you free meals and drinks in a reasonable relation to the waiting time, two free phone calls, e-mails or faxes. If your new flight is leaving only on the next day, a free hotel stay (including free transfer) must be offered.

It doesn’t affect your chances of getting compensation.

1.3 Transavia Flight Cancellation Refund, Transavia Refund Policy

And again, the rules are very specific.

EU flight cancellation refund laws are not affected by Transavia internal policies (Transavia refund policy). If your flight is cancelled — it applies to all flight cancellations, no matter the reason behind cancellation — Transavia should offer you a choice between a new flight and a full refund.

If you choose a refund, it must be paid within 7 days.

You don’t have to agree to a Transavia voucher refund.

Here’s an excerpt from the Regulation (EC) No 261/2004:

Regulation (EC) No 261/2004, Article 5

Cancellation

In case of cancellation of a flight, the passengers concerned shall: (a) be offered assistance by the operating air carrier in accordance with Article 8.

Regulation (EC) No 261/2004, Article 8

Right to reimbursement or re-routing

Where reference is made to this Article, passengers shall be offered the choice between: (a) – reimbursement within seven days (b) re-routing, under comparable transport conditions, to their final destination at the earliest opportunity.

The regulation doesn’t cover cases when you cancel a Transavia flight yourself.

2.1 Why Seek Legal Representation?

Why claim Transavia flight compensation with the help of a flight compensation company instead of completing the whole process by yourself?

Here are the main reasons:

  • No more confusion. A group of professionals will guide you through the necessary documents and handle the submission on your behalf.
  • Seamless and effortless process. A flight compensation company will care of your entire claim from start to finish.
  • Save valuable time and avoid unnecessary stress. Simply submit your documents online, and a flight compensation company will handle the rest. You no longer have to deal with it yourself. It takes just a few minutes to make a claim.
  • Improved chance of success. Working with a flight compensation company can significantly improve your chances of success in claiming compensation. You don’t have to deal with unfair claim rejection.
  • No win, no fee. Usually flight compensation companies charge a fee only when you receive your compensation. You’ll pay nothing, if they can’t get your compensation. However, it’s always best to find this out prior to making the claim.

2.2 How Soon Will You Receive Your Compensation?

How long does the process of claiming compensation take?

If everything goes well — 2 to 3 months. 2 to 3 months from the moment you file a compensation claim until your Transavia flight cancellation compensation is transferred in your bank account. Keep in mind that it could take more than that. Especially if the airline doesn’t want to cooperate or wrongly rejects your claim. Then it might be necessary to take your case to a national enforcement body or even court. It may add at least a couple of months, sometimes more, to the whole process.

If you do it yourself and for the first time, it takes longer than that.

3. How Much Can You Claim?

The compensation amount in the EU go up to €600 per person.

Here is how you can calculate your Transavia compensation:

When your destination is within the EU/UK:

€250

If the distance of your flight is
up to 1,500 km

€400

If the distance of your flight is between 1,500 – 3,500 km

When your destination is outside the EU/UK:

€250

If the distance of your flight is
up to 1,500 km

€400

If the distance of your flight is between 1,500 – 3,500 km

€600

If the distance of your flight is more than 3,500 km

There’s one exception. When the flight distance is 3500+ kilometres and you reach your destination 3 to 4 hours later than planned, you are entitled only to 50% of the compensation amount (that means €300, not €600).

3.1 Transavia Voucher Refund or Cash?

What if you are offered a voucher instead of compensation?

Many airlines were offering vouchers during the COVID crisis, and many do that regularly. Have you been offered a Transavia voucher as flight compensation? Do you have to accept a voucher instead of compensation?

No. According to the EU regulations, compensation and refund has to be paid by bank transfer. Offering coupons is against the law.

4. What Happens If a Flight Is Cancelled?

What to do if your Transavia flight is cancelled?

First of all, wait for the email from Transavia.

This email will contain all the information you need — what happens next, and what are the options in case of flight cancellation. But what if you are at the airport when your flight is cancelled? What if it’s a very last-minute cancellation? Wait for the announcement from the airline. It will come soon. As your flight is cancelled, there will be a new flight. A new boarding pass. You will need to check in for that flight. That’s why it’s important you stay at the public access area of the airport. If you have already gone through security, go back to the public access area where all the check in desks are located.

Can I get a refund instead of a new flight? In most cases, you’ll be given a choice between a new flight and full refund. You can also ask for a refund yourself, if you don’t wish to travel anymore. If you choose a refund, take into account that you won’t receive it right away. Usually the refunds are made within 7 days.

If your flight is cancelled due to the fault of Transavia, the airline is also obliged to pay compensation. If your flight is cancelled less than 2 weeks before departure due to airline’s fault, make a compensation claim.

4.1 Connecting Flights

Do you need to be on time for another flight?

If it’s an airline connecting flight, you don’t have to worry. If you miss your connection because your previous flight was delayed or cancelled, the airline will book you on another flight free of charge.

Even though Transavia is a low-cost airline, it offers protected connecting flights (Transavia Smart Connect). Transavia offers protection in the event of cancellation or delay of one of the flight legs.

What if it’s a self transfer? What if you booked your flights separately? Then it’s your responsibility to make it in time. If you miss your connection, you won’t be booked on a new flight. You will have to buy a new ticket yourself.
