  5. Unruly behaviour and intoxication. To ensure a peaceful flight for all, passengers displaying unruly behaviour or those who appear to be too intoxicated to follow safety instructions may be denied boarding.

It’s important to note that in cases of denied boarding due to overbooking, airlines are required to provide denied boarding compensation and alternative arrangements for affected passengers, as mandated by relevant regulations and laws.

This article will focus on situations where passengers are denied boarding due to overbooking, and how EU laws protect passengers in such cases.

1. Transavia Overbooking Compensation: EU Denied Boarding Regulations

If you’re flying to or from Europe with Transavia, and you are denied boarding due to overbooking — you are entitled to flight overbooking compensation (EU denied boarding compensation) up to €600. Because it’s the airlines fault you have been denied boarding. And if it’s the airline’s fault, you can get compensation.

Keep in mind that this only applies to overbookings.

You won’t be entitled to compensation if you are denied boarding due to visa issues or expired (or about to expire) passport. Or if you voluntarily give up your seat.

1.1 Voluntary Denied Boarding

What is voluntary denied boarding?

Yes, there are different types of denied boarding. 

When a flight is overbooked, an airline will look for volunteers to give up their seats and travel later, on another flight. A volunteer is given a new ticket, free meals, instant compensation in form of vouchers or cash, and, in the event of overnight wait, a free hotel stay. 

The thing is, you don’t have to agree to an offer like this. But if you do, it’s called voluntary boarding denial.

And if you are denied boarding voluntarily, you can’t get compensation.

You aren’t entitled to denied boarding compensation from Transavia.

1.2 Involuntary Denied Boarding

There are situations when passengers don’t have a choice.

There are no volunteers. Or there are not enough volunteers. In this case, the airline will bump passengers from the plane involuntarily. If you are among these passengers, you are entitled to compensation from Transavia. Just because you were denied boarding involuntarily. You weren’t asked if you agree to it.

What happens in case of involuntary denied boarding?

  • The airline must give you a choice between a new flight and a full refund;
  • In addition to that, you are entitled to receive care from the airline*;

All passengers travelling with Transavia have a right to care.

If you were denied boarding to overbooking, you have a right to care. Even if you were denied boarding voluntarily. You can’t get compensation in case of voluntary denied boarding, but you have still a right to receive care from Transavia. 

What does this mean for you as a passenger? If you have to wait at the airport for a new flight, the airline has to offer you certain services for free. The airline must offer you free meals and drinks in a reasonable relation to the waiting time, two free phone calls, e-mails or faxes. If you have to wait overnight, you must be provided with a free hotel stay and free transfer.

It applies to all situations when you have to wait for 3 or more hours extra.

Including flight delays and cancellations, as well as flight disruptions caused by extraordinary circumstances.

2.1 How Long Does It Take?

Every case is different.

If the airline cooperates, and everything goes smoothly, the process could take about 2-3 months. But if the airline wrongly refuses your claim, it will be necessary to take your case to a national enforcement body or court. It will take more time in this case.

3. How Much Can You Claim?

In the EU, the compensation amounts are fixed.

In most situations they range from €250 to €600.

Here is how you can calculate Transavia compensation yourself:

This is also the amount you should be demanding, if you are claiming flight compensation yourself. Transavia may offer you a smaller compensation. But you don’t have to agree to anything less than you are entitled to. The compensation amounts are regulated by the European Union.

There’s one exception. When the flight distance is 3500+ kilometres and you reach your destination 3 to 4 hours later than planned, you are entitled only to 50% of the compensation amount (that means €300, not €600).

3.1 Transavia Voucher Code, Discounts or Cash?

According to the law, compensations have to be paid in cash or by bank transfer.

However, airlines do not always obey the law. They take advantage of people’s lack of knowledge and offer their customers coupons instead of money. Have you been offered Transavia voucher refund or voucher compensation? You don’t have to accept the vouchers. Ask for money instead. 

All airline compensations and refunds in the EU have to be paid in cash or by bank transfer.

My flight cost only €20 (or less). Am I still entitled to compensation?

Yes, because the price of the ticket doesn’t matter.

You are paid for the inconvenience. If your flight is delayed, cancelled or overbooked due to the fault of the airline, you might be entitled to compensation. It doesn’t matter how much did the ticket cost. 

I don’t have travel insurance. Can I claim compensation?

Yes.

You don’t have to provide insurance documents when you claim compensation. If you are entitled to compensation, you can claim it without having an insurance policy.

Can my child/baby get compensation from Transavia?

Yes, they can.

If you are entitled to EU flight compensation, then your child will be too.

Even infants with a special infant ticket can get compensation.

Can I claim compensation for another person?

Yes, you can.

Even if you weren’t on that flight yourself.

As long as they provide you with all the paperwork (passport copy, boarding pass, etc.). Also they will have to sign documents Transavia and the flight compensation company may ask to sign in order proceed.

How far back can I claim flight compensation?

It depends on the laws of the country.

But the laws in Europe allow you to claim compensation even for old flights (that were 2-3 years ago). However, for the best results, we would recommend you to make a claim as soon as you return from your trip. 

What to do if Transavia is denying my claim?

Transavia is refusing to pay compensation even though you are entitled to it.

My passport is about to expire / I don’t have a visa. If I am denied boarding because of that, can I get compensation?

No.

You can only get compensation if you have been involuntarily denied boarding because of overbooking. If you are denied boarding because of something else, you aren’t entitled to compensation.  

EU – Non-EU Flights, Tourists

I’m flying to the EU from a country outside the EU. Can I get compensation?

If you’re flying with Transavia then yes, you can.

On all Transavia flights you are protected under the EU law. If your flight is delayed, cancelled or overbooked due to the fault of the airline, you might be eligible to compensation. 

I’m flying from the EU to a country outside the EU. Can I get compensation?

If you are flying with Transavia, yes, you can.

I am not a European. Can I get compensation?

Transavia provided me with a free hotel room and a free flight to my destination. Can I still get compensated for the delay?

Yes.
